1.6 -正式投诉

Formal complaint means a document filed by a complainant or signed by the Title IX Coordinator (in a Coordinator Initiated Complaint) alleging 不正当的性行为 against a 被调查者 而且 requesting that vnsc威尼斯城网页 investigate the allegation of sexual harassment. 1.6(a) – Formal Complaint 需求

1) A Formal Complaint may only be submitted by the individual who is alleged to be the victim of conduct that could constitute sexual harassment or any of the violations defined in this policy

2) At the time of filing a Title IX or Non-Title IX formal complaint, the complainant must be participating in or attempting to participate in the education program or activity of vnsc威尼斯城网页.

3) A Formal Complaint may not be filed anonymously. 投诉人不能保持匿名，也不能阻止投诉人通过书面举报通知向答辩人披露其身份.

Upon receipt of a Title IX or Non-Title IX formal complaint 而且 approval by the Title IX Coordinator as described below in 1.62、第九条办公室将向已知的当事人提供以下书面通知:

1.62 M而且atory/Discretionary Dismissal 而且 Consolidation of Formal  Complaints

The dismissal of a Formal Complaint may be appealed by either party.

1.62.2 - Discretionary Dismissal / Complaint Withdraw

4. When the complainant has stopped participating in the investigation but has not sent a written withdrawal request 而且 the only inculpatory evidence available is the complainant’s statement in the formal complaint or as recorded in an interview by the investigator.

1.62.3 - Consolidation of Complaints

1.63 Timing of Formal Complaints

1.64 Title IX Coordinator 迹象 the Formal Complaint

1.7 - Informal Resolution Process

An informal resolution process may also include a remedies-based process (mediation), which allows both 参与者 to come to a mutual agreement regarding the resolution of the complaint. 非正式决议可使双方达成协议, 由第九条协调员或其指定人员协助, 这包括持续的支持措施，但也可能包括纪律措施, while providing finality for both 方 in terms of resolving allegations raised in a formal complaint of sexual harassment.

The Informal Resolution Process may not be used to resolve a Formal Complaint alleging that an employee sexually harassed (1.21)学生.

The 参与者 in any informal resolution process will not be required to interact with each other directly. 而不是, the Title IX Coordinator or designee will arrange for or facilitate a remedies-based process or other form of mediation between the involved 参与者 who are in different rooms. Once an informal resolution process is complete, both 参与者 will be notified simultaneously/ contemporaneously (to the greatest extent possible, 而且 consistent with FERPA or other applicable law) of the resolution. Either party may withdraw from the Informal Resolution process at any time prior to signing the agreement. If the 方 are unable to reach an Informal Resolution agreement, 非正式进程将结束，正式决议将结束

1.71行政协议

The Administrative Agreement is an available form of Informal Resolution where the responding participant may elect to accept responsibility for the alleged policy violation through an Administrative Agreement, bringing an end to the Informal Resolution Process. 要执行行政协议，双方必须承认违反政策, accept the proposed sanction(s), 而且 waive any opportunity for appeal.

At any time prior to the final Informal Resolution/Administrative Agreement either party may withdraw from the informal resolution process 而且 resume the grievance process with respect to the formal complaint.

The Formal Resolution Process requires 而且 will provide an objective evaluation of all relevant evidence—including both inculpatory 而且 exculpatory evidence. 1.8(a) Title IX Formal Resolution Process

The Title IX Formal Resolution Process will follow these steps as articulated in 34 C.F.R. 106.45(5)-(7):

1.8(b) Non-Title IX Formal Resolution Process

1.81.1 Investigation 需求:

6) After all initial interviews are completed 而且 relevant evidence has been collected, the 调查员 will send that compilation of evidence to both 方 而且 their advisors for review 而且 response. This Compilation of Evidence contains the evidence obtained as part of the investigation that is directly related to the allegations raised in a formal complaint, including the evidence upon which vnsc威尼斯城网页 does not intend to rely in reaching a determination regarding responsibility 而且 inculpatory or exculpatory evidence whether obtained from a party or other source, 以便各方在调查结束前对证据作出有意义的回应. Parties will have 10 days to submit their responses to the investigator.

1.81.3 – Investigative Report Created, Sent to Parties

8) The Investigative Report will then be submitted electronically to both 方 而且 their advisors. Both 方 will have ten days to review 而且 respond to the Investigative Report. 双方必须向调查员提交答复.

1.82 Live Hearing (Title IX Sexual Harassment Only)

1.82.1 -聆讯令

The Live Hearing will proceed as follows:

1) Opening Statement by the Decision Maker, Complainant, 而且 Respondent.

2) Examination of the Complainant by: Decision Maker, then Respondent Party Advisor

3) Examination of the Respondent by: Decision Maker, then Complainant Party Advisor

4) Examination of Witness One by: Decision maker, then Complainant Party Advisor, then Respondent Party Advisor. (重复步骤4，直到所有证人都被询问完毕.)

5)任何一方顾问均可要求对方当事人或任何证人进行简短的传讯.

1.82.2 -数字听证请求

At the request of either party, The 第九条办公室 must provide for the live hearing to occur with the 方 located in separate rooms with technology enabling the decision-maker 而且 方 to simultaneously see 而且 hear the party or the witness answering questions.

1.82.3 -交叉检查

This determination will be made in real time; cross exam questions may not be approved as relevant or not relevant before the hearing. When the Party Advisor objects to the Decision Makers ruling on Relevance, they may make a brief statement to the Decision Maker as to why the question is relevant 而且 doesn’t call for privileged information or non-relevant sexual behavior. The Decision Maker will either allow the question or rule it as not relevant.

Questions 而且 evidence about the complainant's sexual predisposition or prior sexual behavior are not relevant, unless such questions 而且 evidence about the complainant's prior sexual behavior are offered to prove that someone other than the 被调查者 committed the conduct alleged by the complainant, or if the questions 而且 evidence concern specific incidents of the complainant's prior sexual behavior with respect to the 被调查者 而且 are offered to prove consent.

1.82.7 -礼仪规则

1.82.10 – Reasonable Time Limit on Hearing / Break

The Live Hearing will have a reasonable time limit determined by the Decision Maker. The Decision Maker may grant short breaks on their own, or as requested by the 方.

1.83 Determination Regarding Responsibility

(A) Identification of the allegations potentially constituting sexual harassment as defined in this policy.

(C) Findings of fact supporting the determination;

If a student is ineligible to re-enroll at vnsc威尼斯城网页 for a reason other than an academic or financial reason, vnsc威尼斯城网页 will include on that student’s transcript a notation stating that the student is ineligible to re-enroll for a reason other than an academic or financial reason.

If a student withdrawals or graduates from vnsc威尼斯城网页 pending disciplinary charges that may result in the student becoming ineligible to re-enroll in the college, the college will not end the disciplinary process until there is a final determination of responsibility. 1) Appeals must be submitted in writing to the Title IX Coordinator within 7 days of the 参与者 receiving either the Dismissal of a Formal Complaint or any allegations therein, or the Decision Regarding Responsibility.
