1.6 -正式投诉

Formal complaint means a document filed by a complainant or signed by the Title IX Coordinator (in a Coordinator Initiated Complaint) alleging 不正当的性行为 against a 被调查者 而且 requesting that vnsc威尼斯城网页 investigate the allegation of sexual harassment. 1.6(a) – Formal Complaint 需求

1) A Formal Complaint may only be submitted by the individual who is alleged to be the victim of conduct that could constitute sexual harassment or any of the violations defined in this policy

2) At the time of filing a Title IX or Non-Title IX formal complaint, the complainant must be participating in or attempting to participate in the education program or activity of vnsc威尼斯城网页.

3) A Formal Complaint may not be filed anonymously. 投诉人不能保持匿名,也不能阻止投诉人通过书面举报通知向答辩人披露其身份.

4) The Formal Complaint should contain all known details about the allegations of misconduct including: date & time, 位置, 方, 发生了什么事, 目击者, 以及其他与投诉有关的资料.

Upon receipt of a Title IX or Non-Title IX formal complaint 而且 approval by the Title IX Coordinator as described below in 1.62、第九条办公室将向已知的当事人提供以下书面通知:

1.62 M而且atory/Discretionary Dismissal 而且 Consolidation of Formal  Complaints

1.62.1(a) -强制驳回第九条正式投诉

Upon receipt of a Title IX formal complaint, the Title IX Coordinator will review the listed information 而且 make a determination regarding whether the Formal Complaint must be dismissed or may continue through the Title IX process. 如果第九条正式投诉中指控的行为:1)不构成被禁止的不当行为(如本政策第1条中的定义).2、不包括第1节.22)即使被证实,2)没有发生在奥斯汀学院的教育计划或活动中(第1节).1(a)), 3)没有发生在美国的人, or 4) if the  complaint was not filed by a named Complainant (or the Title IX Coordinator) participating in or attempting to participate in the college’s education program or activity, then the Title IX  Coordinator must dismiss the formal complaint with regard to that conduct for purposes of sexual harassment under Title IX; such a dismissal does not preclude action under another provision of vnsc威尼斯城网页’s code of conduct if applicable. If there is more than one allegation of misconduct, the trained college designee will make a determination as to each allegation. 如果正式投诉中的任何或所有指控被驳回, all 方 will receive notice of the decision 而且 an explanation for the decision. The dismissal of a Formal Complaint may be appealed by either party.

1.62.1(b) -强制驳回非第九条正式投诉

1.62.2 - Discretionary Dismissal / Complaint Withdraw

奥斯汀学院第九条协调员可以驳回正式投诉或其中的任何指控, if at any time during the investigation or hearing: A complainant notifies the Title IX Coordinator in writing that the complainant would like to withdraw the formal complaint or any allegations therein; the 被调查者 is no longer enrolled or employed by vnsc威尼斯城网页; or specific circumstances prevent vnsc威尼斯城网页 from gathering evidence sufficient to reach a determination as to the formal complaint or allegations therein. If a Formal Complaint is dismissed both 方 will receive notice of the decision 而且 an explanation for the decision.

  4. When the complainant has stopped participating in the investigation but has not sent a written withdrawal request 而且 the only inculpatory evidence available is the complainant’s statement in the formal complaint or as recorded in an interview by the investigator.

1.62.3 - Consolidation of Complaints

1.63 Timing of Formal Complaints

1.64 Title IX Coordinator 迹象 the Formal Complaint

1.7 - Informal Resolution Process

在适当的地方, the informal resolution process can be used to resolve allegations of 不正当的性行为 or interpersonal violence by taking immediate 而且 corrective action to stop the conduct, 处理其影响, 而且 prevent recurrence without implementing a formal resolution process. An informal resolution process may also include a remedies-based process (mediation), which allows both 参与者 to come to a mutual agreement regarding the resolution of the complaint. 非正式决议可使双方达成协议, 由第九条协调员或其指定人员协助, 这包括持续的支持措施,但也可能包括纪律措施, while providing finality for both 方 in terms of resolving allegations raised in a formal complaint of sexual harassment.

The Informal Resolution Process may not be used to resolve a Formal Complaint alleging that an employee sexually harassed (1.21)学生.

The 参与者 in any informal resolution process will not be required to interact with each other directly. 而不是, the Title IX Coordinator or designee will arrange for or facilitate a remedies-based process or other form of mediation between the involved 参与者 who are in different rooms. Once an informal resolution process is complete, both 参与者 will be notified simultaneously/ contemporaneously (to the greatest extent possible, 而且 consistent with FERPA or other applicable law) of the resolution. Either party may withdraw from the Informal Resolution process at any time prior to signing the agreement. If the 方 are unable to reach an Informal Resolution agreement, 非正式进程将结束,正式决议将结束

1.71行政协议

The Administrative Agreement is an available form of Informal Resolution where the responding participant may elect to accept responsibility for the alleged policy violation through an Administrative Agreement, bringing an end to the Informal Resolution Process. 要执行行政协议,双方必须承认违反政策, accept the proposed sanction(s), 而且 waive any opportunity for appeal.

At any time prior to the final Informal Resolution/Administrative Agreement either party may withdraw from the informal resolution process 而且 resume the grievance process with respect to the formal complaint.

The Formal Resolution Process requires 而且 will provide an objective evaluation of all relevant evidence—including both inculpatory 而且 exculpatory evidence. 1.8(a) Title IX Formal Resolution Process

The Title IX Formal Resolution Process will follow these steps as articulated in 34 C.F.R. 106.45(5)-(7):

1.8(b) Non-Title IX Formal Resolution Process

1.81.1 Investigation 需求:

1) It is the responsibility of the 调查员(s) to gather the evidence relevant to the formal complaint 而且 the facts raised in the participant’s statements, provided that the 调查员 cannot access, 考虑, 披露, or otherwise use a party's records that are made or maintained by a physician, 精神病学家, 心理学家, or other recognized professional or paraprofessional acting in the professional's or paraprofessional's capacity, or assisting in that capacity, 并且是在向当事人提供待遇时作出和维持的, 除非调查人员获得当事人的自愿, 书面同意这样做. 参与者应向研究者提供他们认为与研究相关的信息

6) After all initial interviews are completed 而且 relevant evidence has been collected, the 调查员 will send that compilation of evidence to both 方 而且 their advisors for review 而且 response. This Compilation of Evidence contains the evidence obtained as part of the investigation that is directly related to the allegations raised in a formal complaint, including the evidence upon which vnsc威尼斯城网页 does not intend to rely in reaching a determination regarding responsibility 而且 inculpatory or exculpatory evidence whether obtained from a party or other source, 以便各方在调查结束前对证据作出有意义的回应. 1.82 Live Hearing (Title IX Sexual Harassment Only)

1.83 Determination Regarding Responsibility

If a student is ineligible to re-enroll at vnsc威尼斯城网页 for a reason other than an academic or financial reason, vnsc威尼斯城网页 will include on that student’s transcript a notation stating that the student is ineligible to re-enroll for a reason other than an academic or financial reason.

If a student withdrawals or graduates from vnsc威尼斯城网页 pending disciplinary charges that may result in the student becoming ineligible to re-enroll in the college, the college will not end the disciplinary process until there is a final determination of responsibility. 1) Appeals must be submitted in writing to the Title IX Coordinator within 7 days of the 参与者 receiving either the Dismissal of a Formal Complaint or any allegations therein, or the Decision Regarding Responsibility.
